These Terms of Service apply to users of the JasaMerek.com website.<\/p>

Throughout this document, JasaMerek.com may be referred to as “we,” “us,” or “our,” while the user may be referred to as “you” or “your.” Please read these Terms carefully, as accessing or using any service on JasaMerek.com means you agree to be bound by them.<\/p>

1. General Terms<\/strong><\/p>

You agree, and are responsible for complying with, all guidelines, notices, operating rules, policies, and instructions relating to your use of and access to our services, along with any updates we make to them from time to time as our services continue to evolve in form and scope.<\/p>

We reserve the right to request information or data related to your use of our services at any time. If you decline to provide the information requested, or if you provide information that is inaccurate, misleading, or fraudulent, or if we have reasonable grounds to suspect that you have done so, we may suspend or deactivate your access to our services.<\/p>

JasaMerek.com reserves the right to add to, remove, modify, or otherwise change these Terms of Service at any time without prior notice.<\/p>

2. Restrictions on Use<\/strong><\/p>

By visiting and using the JasaMerek.com website, including any of its features and services, you agree that you will not:<\/p>

i. Use this Site to violate any applicable law or for any unlawful purpose, including but not limited to laws concerning discrimination based on race, religion, or ethnicity, obscene content, consumer protection, unfair competition, and defamation, or to infringe the rights of others or the terms set out in these Terms of Service.<\/p>

ii. Transmit or distribute viruses or any similar technology, or anything else designed to interfere with, damage, or harm the JasaMerek.com website, its affiliates, or other users, or to disrupt the normal operation of the Site.<\/p>

iii. Use the JasaMerek.com website in any way that infringes or harms the rights of another person, organization, or legal entity, including but not limited to intellectual property rights, confidentiality rights, or privacy rights.<\/p>

3. User Rights and Obligations<\/strong><\/p>

You agree to:<\/p>

i. Make communication easier throughout the scope of our services by ensuring that a designated contact person within your organization or company is authorized to issue instructions to JasaMerek.com.<\/p>

ii. Respond to any request for information, data, or supporting documents related to your chosen service, and return any required forms, including signing documents, for JasaMerek.com.<\/p>

iii. Accept these Terms of Service.<\/p>

4. Liability and Indemnification<\/strong><\/p>

Regardless of any loss you may incur, and to the fullest extent permitted by applicable law, JasaMerek.com and its subsidiaries, affiliates, officers, employees, agents, partners, and licensors will not be liable for any special, incidental, indirect, or consequential damages of any kind. This includes, without limitation, damages for loss of profit, loss of data or other information, business interruption, personal injury, or loss of privacy arising out of, or in any way connected to, your use of, or inability to use, our services, or any software or hardware used in connection with them, even if we or any of our suppliers have been advised of the possibility of such damages, and even if a remedy under these Terms fails of its essential purpose.<\/p>

5. Trademark Services<\/strong><\/p>

Trademark Search<\/strong><\/p>

a. Once you have completed the request form for our Trademark Search service and paid the applicable fee, we will carry out an analysis and search based on the information you provided in that form.<\/p>

b. The Trademark Search will be conducted based on the data you entered in the form or requirements checklist.<\/p>

c. The search is carried out per trademark class, based on the class or classes relevant to your needs, and is checked against trademark records officially published by the Directorate General of Intellectual Property (DGIP).<\/p>

d. The result of this service is a Trademark Search Report, expressed as a percentage reflecting the likelihood of a successful registration.<\/p>

e. This service is considered complete once we have sent you the results of the analysis and search.<\/p>

f. Any decision you make afterward based on the information provided, whether or not it aligns with our recommendation, remains entirely your own responsibility.<\/p>

Trademark Registration<\/strong><\/p>

a. The fee for our Trademark Registration service consists of the JasaMerek.com service fee plus the government fee (PNBP, Indonesia’s Non Tax State Revenue) set by the Directorate General of Intellectual Property. This fee covers one trademark in one class. If the government raises the PNBP rate after your initial payment has been made, you will need to pay the difference before we can move forward with the process. We will notify you of any such increase, along with the details, as soon as the change officially takes effect.<\/p>

b. Once you have completed the request form for our Trademark Registration service and paid the applicable fee, we will submit your application online based on the form and requirements checklist you provided.<\/p>

c. We will monitor your application on an ongoing basis and notify you if it receives an opposition from a third party, a provisional refusal, or is approved.<\/p>

d. If your trademark is approved and successfully registered, our trademark team will notify you so you can download your e-Certificate. Any consequences resulting from failing to download the certificate are entirely your responsibility.<\/p>

e. The registration fee applies to one trademark in one class. Any error in the application relating to the classification of goods or services, or the selected class, is the applicant’s responsibility.<\/p>

f. Responding to a Provisional Refusal or Opposition. If your application receives a provisional refusal from the Directorate General of Intellectual Property, or an opposition from another trademark owner, we will notify you along with our recommended course of action and the associated cost. This notice will include a deadline for your response. If we do not receive your decision or response within that time, JasaMerek.com will not be held responsible for the refusal of your application or any other setback resulting from a lack of response.<\/p>

g. If a provisional refusal or opposition arises after your registration application has been filed, you still have the opportunity to respond or file an objection, though this comes at an additional cost outside the scope of the Trademark Registration service.<\/p>

h. The registration service is considered complete once we have sent you proof of filing. JasaMerek.com does not offer any refund based on the outcome of the application, whether the trademark is ultimately registered or refused.<\/p>

Other Services Beyond Trademark Registration<\/strong><\/p>

Other services we offer beyond trademark registration, such as renewal, recordal of assignment, appeals, copyright registration, patents, industrial design, or other intellectual property related services, likewise consist of our service fee plus the PNBP government fee set by the Directorate General of Intellectual Property. If the government raises the PNBP rate after your initial payment for such a service, you will need to pay the difference before we can proceed further. We will notify you of any such increase, along with the details, as soon as the change officially takes effect.<\/p>

6. <\/strong>Refund Policy<\/b><\/p>

By making a payment for any JasaMerek.com service, you confirm that you have read, understood, and agreed to these Terms, including the following refund conditions:<\/p>

  1. Full Refund (100%)<\/strong>

    You are entitled to a full refund only if:<\/p>

    • No processing activity has taken place on the part of our consultant team within 3 (three) business days of your documents being confirmed complete<\/li>
    • There is no valid reason for the delay, such as a system queue, additional validation, or an internal legal consideration<\/li><\/ul>

      A refund request will only be processed if no work or service of any kind has been carried out.<\/p><\/li>

    • Partial Refund (After Service Has Been Used)
      <\/b>

      If part of the service has already been delivered, such as:<\/p>

      • An initial consultation, whether in person or online<\/li>
      • An AI check or preliminary trademark search<\/li><\/ul>

        Then any refund will be issued after deducting IDR 500,000 as compensation for the service already provided. Any remaining balance will be returned to you following verification.<\/p><\/li>

      • Refund Not Applicable
        <\/b>

        A refund request will not be accepted if:<\/p>

        • A draft application has already been prepared or submitted<\/li>
        • The application has already been filed with DGIP<\/li>
        • Administrative processing or legal assistance has already begun<\/li>
        • The service is explicitly stated as non refundable in its description or offer<\/li>
        • The requested documents are not received by JasaMerek.com within 6 (six) months of the initial request, and you provide no response or further information, causing the service to stall or come to a halt. In this case, all fees already paid are considered forfeited and non refundable, except for any PNBP government fee that has not yet been paid to DGIP.<\/li><\/ul><\/li>
        • Refund Request Procedure<\/b>
          • Requests must be submitted in writing to our official JasaMerek.com email address<\/li>
          • You must include proof of payment and the reason for your request<\/li>
          • Once approved, refunds will be processed within 14 business days, following our internal verification<\/li><\/ul><\/li>
          • Statement of Agreement
            <\/b>

            By making payment, you confirm that you:<\/p>

            • Agree unconditionally to these terms<\/li>
            • Waive any right to claim a refund outside the conditions set out here<\/li><\/ul><\/li><\/ol>

              7. <\/strong>Termination<\/strong><\/p>

              Under our policy, please note that JasaMerek.com reserves the right to give notice of termination of work, while retaining the right to collect any outstanding service fees, if:<\/p>

              a. At any point after agreeing to our services, you fail to carry out or otherwise breach the obligations set out in these Terms.<\/p>

              b. It comes to light that you, or another party acting or claiming to act on the applicant’s behalf, have taken any action without our knowledge.<\/p>

              Terminating an agreed service requires prior written notice along with the reason for termination.
